In accordance with APD policy, information regarding this critical incident has been shared promptly to maintain transparency. The department is collaborating with the Office of Police Oversight and the City of Austin to release relevant audio and video from the investigation. These materials have been reviewed by both the Travis County District Attorney’s Office and the Office of Police Oversight.
The officer involved in the shooting has been placed on administrative leave as per standard protocol. On May 17, officers responded to emergency calls reporting a male subject in a wheelchair, identified as Danny Palomino, who allegedly had a black pistol in his lap while positioned in the roadway. One caller reported that Mr. Palomino pointed a gun at her.
Officer Jackson arrived at 9:53 a.m., observing Mr. Palomino with what appeared to be a black pistol. Despite Officer Jackson’s commands for Mr. Palomino to stop and put his hands up, Mr. Palomino raised his weapon towards Officer Jackson. This prompted Officer Jackson to fire shots at Mr. Palomino.
After being shot, Mr. Palomino fell but sat back up with the gun still in hand. Officer Jackson continued issuing commands before firing additional shots, causing Mr. Palomino to fall again. Responding officers secured him and discovered he was holding an air pistol resembling a Glock handgun.
Mr. Palomino was transported to South Austin Hospital where he was pronounced deceased. No other individuals or officers were injured during this event.
The incident was captured on body-worn cameras, dash cameras, and bystander cellphones; however, these recordings may not encompass all perspectives of those present during the event.
